Terms and Conditions

For the purpose of these Terms and Conditions Finca Las Tobas will be also be known as “the company” ”we” “us” and “our” where stated. Likewise the customer or client (an individual or group booking) will be known as “the participant” “guest” “you” “your” or “the party”. “The Retreat” refers to the whole package – full board accommodation and art course.

  1. Each Art Retreat participant must agree to these Terms and Conditions. By completing the online Booking Form, all members of the party are deemed to have read and accepted these Terms and Conditions and accept full responsibility for all payments due to us in respect of the holiday booked.
  2. We work with a range of suppliers to provide accommodation, food, transport, tuition, materials and activities. In these cases the Terms and Conditions of the third party providers will also apply.
  3. A non-refundable deposit of £150 per person is required to reserve your place. We will only refund your deposit if we have to cancel a retreat.
  4. Final payment is due 60 days before the start of the retreat at the latest, to confirm your place. Bookings are only confirmed when the balance has been received. If final payments are not received when due, the company reserves the right to cancel your reservation and accept new reservations for your space.

    Payment is by cheque or bank transfer. Details are given on your confirmation invoice.

  5. The Art Retreat cost includes:
    • Tuition fees.
    • Course materials and use of equipment on site.
    • 7 night’s accommodation (in a shared villa unless paying a single person supplement)
    • Continental breakfast and buffet lunch (with the exception of one lunch per week, on the ‘free’ day).
    • Refreshments provided during the course.
    • Airport transfers (only when pre-booked) between Seville Airport and Finca Las Tobas, for recommended flights.
  6. The Art Retreat cost does not include:
    • Airfares to Spain or any other transport/travel costs, such as car hire, taxis, public or private transport, petrol costs or any other personal travel costs or insurances needed or incurred either before, during or after the retreat other than listed above. If participants wish to make their own travel arrangements to the venue to arrive on a different day/times than the ones we advise, we are not liable for any travel costs incurred, including any extra transfers from airports. We will only pick up and drop off guests from/to the designated airport and on the designated date/s when pre-booked.
    • Any extra materials or equipment.
  7. It is your responsibility to obtain passports, visas, health certificates or any other documentation required for your trip.
  8. You should only book your flights / make travel arrangements once your reservation on the Art Retreat has been confirmed.
  9. We strongly advise that guests either have or take out their own holiday and/or medical insurance before attending the retreat, as the company will not be responsible for any of these costs.
  10. Guests are liable to pay for any damages incurred by them during their stay at either the onsite and offsite venues.
  11. There are no refunds, including for cancellation, no shows, arriving after the retreat start date, or if you choose to leave before the end of the retreat. It is your responsibility to obtain holiday cancellation insurance.
  12. The Company reserves the right to change course content and replace the facilitating tutor. In these cases we will endeavour to find a suitable replacement tutor and guarantee that the standard of the course will not change.
  13. The company reserves the right to make modifications and/or changes to the program and /or accommodation as is deemed necessary. We also reserve the right to cancel any courses or holidays at any time. In the unlikely event of a cancellation, or that we are unable to complete a course for reasons beyond our control, you may
    1. transfer to another date if the retreat has not begun
    2. receive a full refund of money paid if the retreat has not begun
    3. receive part refund if retreat was in progress.
    We are not responsible for any consequential expenses or damages incurred as a result of any cancellation or change, including, but not limited to costs spent in preparation, non-refundable or penalty-carrying airline tickets, special clothing, visa and passport fees, lost income and any other related losses or expenses.
  14. The company is not responsible for any injury to persons or loss, theft or damage of personal property. Guests use the facilities at their own risk.
  15. Guests must vacate the premises by 12 noon on the last day of the retreat week, unless otherwise agreed with the accommodation manager.
  16. Unless otherwise stated all retreats are designed for adults over 18 years of age. There is no upper age limit.
  17. We are not responsible for any unexpected occurrences, including those rendered by weather, political conditions, local infrastructure, wildlife or acts of God.
  18. If any part of these terms is deemed invalid, the remaining terms are still valid.
  19. The law of England, Wales and Northern Ireland covers these Terms and Conditions. In the event of a dispute the customer will agree that the dispute will be determined by arbitration by an arbitrator appointed by the President of the Chartered Institute of Arbitrators. By registering on our retreats customers agree to our Terms and Conditions.
